Isn't Defensive Driving Always an option? - Legal Help


I don't think an attorney being nasty and condescending is a violation of any ethics rules. If it were, there would be many, many complaints filed.

As far as the deal that the prosecutor offers you, it is usually in his discretion whether to make a plea deal or not. District attorneys can normally make and withdraw plea deals whenever they please.

I am not familiar with the specific laws of Texas, but in other states, you don't need permission from the district attorney to take defensive driving classes. What happens usually is that an individual will plead guilty to the traffic violation. Then they take the defensive driving class with the DMV and get 2 points removed from their record. The traffic violation will still show up but you will save on insurance by not having those 2 extra points.
