Samsung Request for New Trial Denied, Did Infringe Apple Patents, Though Unwillingly

It was only a matter of time before the next episode of the patent war between Apple and Samsung aired. Compared to others, though, this one's plot, if it can even be called that, was surprisingly ambivalent.

Samsung has been trying to get Judge Lucy Koh to approve of a retrial of the patent infringement case against Apple, after the ruling in favor of the latter, which said that many Galaxy devices used Apple technologies unlawfully.

Naturally, Samsung has been doing all it can to get the large settlement payment decision rescinded, and all bans lifted.

Unfortunately for the corporation, the US court has a very different opinion than that of the Dutch court or the UK law system.

Judge Koh has denied Samsung's request for a new trial because it ?would be contrary to the interests of justice.?

She did offer a silver lining though, in the shape of an admission that Apple failed to prove that Samsung willfully infringed Apple's patents.

Samsung argues that the patents were invalid, so the infringement cannot be considered willful.

That is legal jargon for Samsung believing that it was doing nothing wrong when it built those phones and tablets.

This conclusion is far from what Samsung hoped, but it does, at least, mean Apple won't be getting its wish to increase the ?damages? that its rival has to pay.

For those who've forgotten, the jury in the San Jose court, whether or not it was due to the foreman's alleged misconduct, decided that Samsung had to pay $1.049 billion / 780 million Euro, back in August 2012.

Since the ruling supposed that five of the instances of infringement were willful, and the Judge has now decided they were not, the sum may be decreased. No ruling to this effect has been given yet, however, and Apple will surely fight one with all it has.

Second set of NATO Patriot missiles in Turkey go active

ANKARA (Reuters) - A second pair of Patriot missile batteries being sent by NATO countries to defend Turkey against possible attack from Syria are now operational, a German security official said on Tuesday.

The United States, Germany and the Netherlands each committed to sending two batteries and up to 400 soldiers to operate them after Ankara asked for help to bolster its air defenses against possible missile attack from Syria.

The frontier has become a flashpoint in the 22-month insurgency against President Bashar al-Assad, with Syrian government shells frequently landing inside Turkish territory, drawing a response in kind from Ankara's military.

The two German batteries, which have been deployed around the Turkish city of Kahramanmaras some 100 km (60 miles) from the Syrian border, were in position and ready to use as of late Monday, the German security official said.

The first pair of batteries, sent by the Netherlands, went operational on Saturday around the city of Adana, southwest of Kahramanmaras. The final U.S. Patriots are expected to arrive in Turkey on Wednesday and go active in the coming days.

The batteries are being stationed around three southeastern Turkish cities and NATO says they will protect 3.5 million Turks from missile attack. Patriots are capable of shooting down hostile missiles in mid-air.

Tensions have increased in recent weeks after NATO said it had detected launches of short-range ballistic missiles inside Syria, several of which have landed close to the Turkish border. Turkey has scrambled warplanes along the frontier, fanning fears the war could spread and further destabilize the region.

Syria has called the deployment of the batteries "provocative" while Iran and Russia, which have supported Syria throughout the uprising, have criticized NATO's decision, saying the Patriots would intensify the conflict.

Turkey and NATO have strongly denied the Patriot missiles are a precursor to a no-fly zone that Syrian rebels have been requesting to help them hold territory against a government with overwhelming firepower from the air.

All six Patriot batteries will be connected directly to allied air command in Ramstein, Germany.

Microsoft's highly?anticipated Surface Pro tablet, which runs the full version of Windows 8 rather than the poorly?received Windows RT, will come out of the box with nearly two-thirds of its 64 GB of storage filled up. The 128 GB version will likewise boot up with far less room?than many users expect to see.

Microsoft, which confirmed the information to NBC News,?was quick to add that much of this space can be reclaimed, although the method is not one?that tech novices will likely?understand or undertake. Nor are the reasons for the reduced space particularly easy to grasp without some explanation:

First, the gigabytes listed on any gadget's box don't actually correspond to the way computers think about data. The result is that 64 GB shown?on the box (whether the device?runs Windows, Android, or iOS) really translates to 59?of what the computer actually uses ("gibibytes," if you must know).

Second, Windows is a much larger and more complex piece of software than what you find on an Android tablet or iPad. It is, after all, a full-on desktop operating system ? it can do more, run programs from years back, and so on. So naturally, it takes up more space.

Third, because it's a "real" OS, it takes backup very seriously, keeping a "recovery partition," or backup of itself right there on the device ? which takes up even more space. And then you have the built-in apps and the trial version of Office 2013. The end result is that the 64 GB Surface comes out of the box with just 23 GB of usable space, and the 128 GB version is reduced to 83 GB.

The new Apple iPad with 128 GB of space, on the other hand, will likely have about 115 GB out of the box.

The Windows RT tablet had a similar problem, shipping with about half its?space full, resulting in a consumer?backlash, despite Microsoft's insistence that the space crunch was unavoidable.

Users can delete installed apps and move the recovery partition to external storage or delete it entirely, but these tasks aren't exactly simple, especially for less-experienced users.

The capabilities of the Surface Pro tablets are in many ways far beyond those of competing tablets and even many laptops. Microsoft made sure to mention the fact that the device's USB 3.0 interface,?SDXC card slot?and free SkyDrive storage allow for lots of extra storage. But users simply may not be able to get over the fact that their premium device came out of the box with nowhere near the amount of free space they expected.

The Surface Pro will be out in the U.S. on February 9th. The 64 GB version will retail for $899; the 128 GB model, $999.

Boy Scouts of America may end ban on gays

DALLAS (Reuters) - Boy Scouts of America is considering ending a longstanding national ban on gay youth and adult members and leaving policies on sexual orientation to its local organizations, a spokesman said on Monday.

Lifting the ban would mark a dramatic reversal for the 103-year-old organization, which only last summer reaffirmed its policy amid heavy criticism from gay rights groups and some parents of scouts.

The organization's national executive board is expected to discuss lifting the ban on gay members at its regularly scheduled board meeting next week in Texas.

"The policy change under discussion would allow the religious, civic or educational organizations that oversee and deliver Scouting to determine how to address this issue," spokesman Deron Smith said in an email to Reuters.

The Church of Jesus Christ of Latter-day Saints, the United Methodist Church and the Catholic Church have the largest youth membership in the Boy Scouts among faith-based organizations.

The organization, which had more than 2.6 million youth members and more than 1 million adult members at the end of 2012, "would not, under any circumstances, dictate a position to units, members, or parents," Smith said.

The Boy Scouts has also faced criticism for keeping private files covering decades of child sex abuse incidents within the organization. The Scouts released thousands of pages of files in October covering incidents from 1965 to 1985.

The Boy Scouts won a 5-4 U.S. Supreme Court ruling allowing the organization to ban gays in 2000, but has come under increasing public pressure in recent years from activists. They include Zach Wahls, an Eagle Scout with two lesbian mothers, and Jennifer Tyrrell, a lesbian mother from Ohio who was ousted as a Scout den leader and treasurer.

"This is absolutely a step in the right direction," said Wahls, who is founder of Scouts for Equality, a group that includes 3,151 other Eagle scouts.

Wahls said he would turn to persuading local councils to enact nondiscrimination policies if the change is approved.

Tyrrell said she looked forward to a day when she and her family might participate in scouting again.

"An end to this ban will restore dignity to countless families across the country, my own included, who simply wanted to take part in all Scouting has to offer," Tyrrell said in a statement.

GLAAD, an anti-discrimination advocacy group, began to press for a reversal of the Boy Scouts policy after Tyrrell was removed from her son's den and more than 1 million people have signed petitions on Change.org seeking an end to the policy.

More than 462,000 people signed a petition on Change.org calling for the Boy Scouts to grant an Eagle Scout application for Ryan Andresen, a California resident who is openly gay.

Andresen's scoutmaster refused to sign the application because of his sexual orientation. A review board for the California chapter recommended he receive the rank, but its recommendation was never forwarded to national headquarters.

The organization has faced pressure from board members - Ernst & Young chairman and chief executive Jim Turley and AT&T chief executive Randall Stephenson have spoken out against the ban - and some corporations withdrew support over the policy.

United Parcel Service was among corporations that have said they would pull funding from the organization over its policy.

The Family Research Council, which said in December it would pull its business with UPS because the package delivery company had decided to cease funding of the Boy Scouts, said on Monday the Scouts should resist the pressure to change its policy.

"If the board capitulates to the bullying of homosexual activists, the Boy Scouts' legacy of producing great leaders will become yet another casualty of moral compromise," Family Research Council President Tony Perkins said in a statement.

Patrick Boyle, whose 1994 book "Scout's Honor" was among the first to examine sexual abuse in the Boy Scouts of America, said on Monday the "striking reversal in policy" was likely the result of growing pressure from corporations.

"This is a safe way out of this mess for the national organization, which takes the fight back to the local level, and says to a local leader, 'you make the choice that's right for you'," Boyle said. "It's essentially the Boy Scouts' version of states' rights."

FRUCTOSE AND ITS EFFECT ON THE BODY

Fructose is another simple sugar that is found in nature within fruits, honey, and plant/tree nectar. This is metabolized differently than glucose and can cause even more hazardous effects, when consumed in excess.?

THE MAIN?METABOLIC?DIFFERENCES BETWEEN FRUCTOSE AND GLUCOSE

?

  • After eating fructose, most of the metabolic burden rests on your liver. But with glucose, your liver has to break down only 20%.
  • Every cell in your body, including your brain, needs glucose and ?burns it up? immediately after ingestion. By contrast, fructose is primarily converted into free fatty acids (FFAs), VLDL (the damaging form of cholesterol), and triglycerides, which get laid down and stored as fat.
  • The free fatty acids created during fructose metabolism accumulate as fat droplets in your liver and skeletal muscle tissues, causing insulin resistance and non-alcoholic fatty liver disease (NAFLD). Insulin resistance is now extremely common and will lead to metabolic syndrome and type II diabetes.
  • Fructose is the most lipophilic carbohydrate, converting to activated glycerol (g-3-p), which turns free fatty acids into triglycerides. The more g-3-p you have, the more fat you will store. Glucose does not have this same effect on the body.
  • When you eat 120 calories of glucose, less than one calorie is converted to, and stored by the body as fat. In contrast, 120 calories of fructose consumed, results in 40 calories being stored as fat.?
  • The metabolism of fructose by your liver numerous waste products and toxins, including high levels of uric acid, which triggers the body to store fat, causing you to gain additional weight. Glucose does not produce toxins in the liver.
  • Glucose suppresses the hunger hormone ghrelin and stimulates leptin, which effectively suppresses your appetite. Fructose has no effect on ghrelin and interferes with your brain's ability to communicate with leptin, resulting in scientifically proven overeating.

THE HISTORY OF SUGAR CONSUMPTION

Historically, around 1000 years ago, sugar was used in a variety of ways, such as:

  • For medicinal purposes?
  • As a preservative
  • As a spice
  • As a sweetener

Up to the seventeenth century, sugar was an expensive luxury item considered a sign of status and wealth. In England and Wales, from 1663 to 1775, consumption increased twentyfold and rose more rapidly than bread, meat, and dairy products. This was due to a massive increase in the volume of sugar produced, this drove down the price to make it available and affordable to the masses.?

SUGAR PRODUCTION AND THE ENVIRONMENT

Sadly, the environment is negatively affected by sugar production all over the world. Sugar cane is a highly water intensive crop, grown under monoculture conditions, which depletes trace minerals in the soil and leads to soil erosion. Refined sugar is responsible for the greatest loss of biodiversity than any other crop. Forests and natural habitats are destroyed and cleared to make way for sugar crops and excessive amounts of fossil fuel are needed in the production process.?

This process is performed very well in our bodies, when the cells are kept sensitive to the circulating insulin.

Modern lifestyle?behaviors?of excessive sugar intake, processed foods and lack of movement lead to chronically elevated blood sugar and insulin levels. Creating a cellular resistance to insulin, excessive free radical damage and inflammation throughout the body.

ELEVATED LEVELS OF SUGAR AND INSULIN MANIFESTS AS:

Conservative Angst

A well-stocked open bar cures all angst. The reception room at the National Review Institute?s post-election summit has four of ?em, loaded high with rum, whiskey, vodka, and triple sec, and O?Doul?s for those who want to fake it. When there?s an evening lull in the Omni Shoreham?s main ballroom, there?s a party waiting in the mini-ballroom across the beige hallway. Early on Friday evening hundreds of conservatives pack the room, stepping in and out of line depending on whether they?re thirsty or whether they?d rather talk to one of the available icons?Mark Steyn! Jonah Goldberg! Rich Lowry!

I get stuck between Steyn, a ring of his fans, and a bar, where I meet an Orlando dermatologist named Darrin. He?d volunteered for Mitt Romney?s campaign, ?making calls from my office? when he wasn?t working or raising his kids, and he wasn?t surprised when Romney lost, because he doesn?t put any graft past Barack Obama. ?I?m worried about a dictatorship,? he says?really, we have been talking for maybe three minutes before he lays this on me. ?I mean, it happened in history. History repeats. Why couldn?t it? How about all the Muslim Brotherhood czars? He?s got like eight different guys in the administration who are members of the Muslim Brotherhood.?

When I start to sound skeptical, Darrin pulls out his iPhone and forwards me an infographic. It?s titled ?Muslim Brotherhood Infiltrates Obama Administration,? and it shows six Muslims who work in the administration and ?enjoy strong influence.? Another way of putting it: Six mid- and low-level staffers in the administration have, in the past, appeared on panels staged by frightening-sounding organizations. But the evidence worries Darrin. ?If I have to go to a freakin? island to save my kids,? he says. ?I?ll do it. I?ll leave the country.?

Any hack can roll into a political conference, find the most outr? attendees, and pretend that the room was packed with nothing but. National Review is a standard target of this sort of journalism. At least three times, liberals have embedded on the magazine?s biennial post-election cruises, and come out with feature-length contributions to the Those Crazy Conservatives genre. In most respects, Darrin was like the other NRI summit ticket-holders I talked to?a middle-aged guy with a successful business, worried about his lost country, worry deepened by a steady diet of conservative media.

But toward the end of the conference on Sunday, I sit in on a panel titled ?What is a conservative foreign policy?? And in it, National Review?s Andrew McCarthy asks why Huma Abedin had been allowed, for so long, to work alongside Secretary of State Hillary Clinton, holding a security clearance.

?We have people throughout our government who have connections to the Muslim Brotherhood,? says McCarthy. ?Not, like, tenuous connections. Strong connections. We have a situation where, in our intelligence community, they have made a policy of purging information in the training materials of our law enforcement agents, our intelligence agents, and our military people, if the information casts Islam in a bad light?which, back in the 1990s, when I was a prosecutor, we used to call evidence.?

That gets applause, something that was scarce and hard-earned at the weekend conference. National Review has only held two other post-election summits?they save ?em for real debacles. In 1993, William F. Buckley gathered 1,000 conservatives in the nearby Mayflower Hotel, to vent and strategize about the threat of Bill Clinton. In 2007, after Democrats took back Congress, NRI met at the J.W. Marriott up the street to hear from potential 2008 saviors.

?Mark [Steyn] gave an incredible speech at that conference,? recalls Jonah Goldberg, joining Steyn onstage Saturday night for a ?Night Owl? banter session?cash bar this time. ?He closed his speech with one of the funniest lines that?s ever been said on the public stage. Ladies and gentlemen, the next president of the United States, Mitt Romney!?

Laughter and groans. Conservative donors and thinkers respect Mitt Romney more than they did the defeated George H.W. Bush or the ousted, forgotten Speaker Dennis Hastert. In 1993, then-NR editor in chief John O?Sullivan told conservatives that they were in the midpoint of the ?Bush-Clinton? era?that Bush had betrayed the Reagan revolution, and could not be considered part of it. In 2013, Romney is seen as a fundamentally decent man who simply did not know how to ?message? conservatives? beliefs or explain what Obama was doing wrong. ?He spoke conservatism,? says Charles Krauthammer in a Friday night Q&A, ?as a second language.? Speak it as a first language, and you can win.

Every elected Republican at the conference attempts to prove that. On Friday, NR?s Jay Nordlinger asks freshman Rep. Tom Cotton to swat away some of the liberals? myths. Why did Republicans lose Hispanics? ?We?re quasi-racist, or maybe racist without the quasi,? says Nordlinger. ?It?s supposed to be killing us.? Cotton doesn?t know how to fix it. ?I think Romney only got 27 percent [of Hispanic votes], but John McCain four years ago got 31 percent when he?d been the sponsor of an immigration bill,? he says. ?It?s presumptuous and condescending to think that Hispanics, as a class, are only focused on immigration.? Will conservatives have to accept the ?momentum? for gay marriage? ?It?s only this last year that people in any state have decided to accept gay marriage,? says Cotton. ?In California, four years ago, [they] voted for traditional marriage.?
